Vendy Studio

Reporting, removal and retention procedure

This policy sets out the rules applicable to content uploaded to the Vendy Studio platform, how content is deleted, the reporting and removal procedure, and how long data is kept.

1. Permitted content

  • Photographs of garments only;
  • Garments laid flat, on a hanger or placed on the floor;
  • Clothing accessories (shoes, bags, scarves, hats, beanies, jewelry), offered on an experimental basis (beta feature), as the Service is optimized mainly for garments;
  • No identifiable natural person, even partially.

2. Strictly prohibited content

  • Real people or minors;
  • Photographs you do not hold the rights or a license to use;
  • Visible logos or trademarks you have no rights to;
  • Sexual, violent, hateful or unlawful content.

3. Trademarks and intellectual property

You confirm that you hold all rights necessary in respect of the content you upload, including where trademarks are visible. Vendy Studio does not verify those rights.

4. Deletion by the user

Content is private and linked to your account. You may delete your content at any time from your account area.

5. Retention period

Unless deleted manually beforehand, Source Photographs and Generated Images are automatically deleted within a maximum of ten (10) days. Deletion is final and irreversible. Minimal technical logs may be kept without retaining the images (6 to 12 months).

6. Moderation and removal

Vendy Studio may remove, without prior notice, any content that presents a legal, regulatory or reputational risk. In the event of repeat breaches, the account may be suspended or terminated.

7. Reporting (notice and takedown)

Anyone may report content by email at contact@vendystudio.fr, stating the URL or description of the content, the reasons for the report and the reporter's contact details. Removal does not imply any admission of liability.

For copyright complaints specifically, please follow the DMCA notice and counter-notification procedure set out in section 10 of our Terms of Service, which identifies our designated agent and the information your notice must contain under 17 U.S.C. § 512.

8. Repeat infringers

In accordance with 17 U.S.C. § 512(i), Vendy Studio terminates, in appropriate circumstances, the accounts of users who are repeat copyright infringers.

9. Discretion

Vendy Studio has discretion in assessing content and may remove content without prior discussion where necessary.

10. Fair and honest use of the Generated Images

The Generated Images are produced by an automated system and are approximations. Before publishing one on a marketplace, you must check that it fairly represents the garment's cut, length, proportions, actual color and any defect.

Publishing an image that misrepresents an item you are selling may breach the marketplace's rules and consumer protection law, including Section 5 of the Federal Trade Commission Act, which prohibits deceptive acts and practices. You are solely responsible for the listings you publish.
